By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.
1. Our Role and Acceptance of These Terms
Welcome to the website or mobile application operated by SmartPharmaRX LLC. The following Terms govern your access to and use of:
- The SmartPharmaRX LLC website and other digital interfaces owned or operated by SmartPharmaRX LLC or its affiliates (the “Sites”);
- Any other digital tools or technologies made available to you by SmartPharmaRX LLC (the “Platform”);

The Services available through the Platform may include:

- Administrative support in connection with ordering prescription services and scheduling appointments;
- Technology support for using the Platform as a means of direct access to prescription services and healthcare practitioners.
All health-related information or resources available on the Platform are for informational purposes only and are not a substitute for direct healthcare services. Neither SmartPharmaRX LLC nor the Platform provides medical advice or care. You acknowledge that healthcare services are provided by independent healthcare practitioners, and you are not entering into a provider-patient relationship with SmartPharmaRX LLC.
2. Additional Terms and Conditions
Your use of the Platform is governed by our Privacy Policy. Any health information that we hold on behalf of healthcare practitioners is governed by our Notice of Privacy Practices.
In order to access or purchase certain Services available on the Platform, you may be required to agree and enter into, or acknowledge receipt of, one or more additional agreements, consents, assignments, releases, or notices as a condition of accessing, purchasing, or receiving those Services (“Additional Terms”). Such Additional Terms may be specific to a supplier of the Services or Product, including a specific healthcare practitioner or service, and are incorporated into these Terms by reference.
3. Eligibility and Availability
To access the Services through the Platform, you represent and warrant that:
- You are at least 18 years of age or older;
- You reside in the United States and in a state or territory where the Platform is available;
- You agree to be legally bound by and comply with these Terms;
- You have compatible computing and/or mobile devices, sufficient access to the Internet, and necessary software to use the Platform.
If you do not meet all of these requirements, you must not access or use the Platform or any Services available through the Platform.
4. Account Registration
To access certain features of the Platform, you may be required to set up an account (“Account”). To obtain an Account, you may be asked to provide certain registration details or other information. It is a condition of your setting-up an Account that all the information you provide is correct, current, and complete.
You acknowledge that your Account is personal to you and agree not to provide any other person with access to the Platform using your username, password, or other security information. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security.
We have the right to disable any username, password, or other identifier at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms.

6. Services and Products Accessed on the Platform
The SmartPharmaRX LLC platform may include access to a variety of services and products, including but not limited to:
- Health and Wellness Information – General educational content and resources related to health, wellness, and medication management.
- Laboratory Services – Access to clinical laboratory testing services through contracted labs, including test ordering and result retrieval.
- Healthcare Providers – Access to licensed healthcare practitioners (“Providers”) affiliated with independent professional practices. SmartPharmaRX LLC facilitates communication and scheduling with Providers, but does not provide medical care directly.
- Administrative Support – Assistance with scheduling appointments, ordering lab tests, and navigating the platform.
- Technology Support – Tools to enable secure access to lab results, provider communications, telehealth consultations, and other platform functions.
- Products for Purchase – Vitamins, supplements, over-the-counter medications, clinical test kits, and other tangible healthcare products.
All health, medical, and wellness services accessed through the platform are provided by the respective labs, practices, or providers. SmartPharmaRX LLC acts solely as a facilitator and does not establish a provider-patient relationship with users. Users are responsible for consulting their own healthcare providers regarding diagnoses, treatments, or medical advice. SmartPharmaRX LLC does not control or direct the professional judgment of the labs, practices, or providers.
6. Intellectual Property Rights
The Platform and its contents, features, and functionality are owned by SmartPharmaRX LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. No right, title, or interest in or to the Platform or any content on the Platform is transferred to you, and all rights not expressly granted herein are reserved.
7. Disclaimers
The Platform and its Services are provided “as is” and “as available” without warranties of any kind, either express or implied. SmartPharmaRX LLC does not warrant that the Platform will be uninterrupted or error-free.
8. Limitation of Liability
To the fullest extent permitted by applicable law, SmartPharmaRX LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform.
9. Indemnification
You agree to indemnify and hold harmless SmartPharmaRX LLC and its affiliates from any claims, damages, or expenses arising out of your use of the Platform or violation of these Terms.
10. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Florida. Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Any changes will be posted on this page, and the effective date will be updated accordingly. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms.
